We sincerely hope that your experience at Rose City counseling is positive and safe. Below are the steps for communicating concerns you have with the services you have received at Rose City Counseling.

Sec. 181.105. REQUIRED INFORMATION REGARDING CONSUMER ACCESS TO HEALTH RECORDS AND COMPLAINTS. (a) Except as provided by Subsection (b), a covered entity shall prominently post on the entity's Internet website and at any entity facility detailed instructions for a consumer to:
(1) request the consumer's health care records from the entity;
(2) contact the disciplinary or licensing authority for the covered entity; and
(3) file a consumer complaint as described by Section 181.103.
(b) This section does not apply to a covered entity that conducts claims processing, data processing, data analysis, utilization review, or billing on behalf of another covered entity that provides health care services directly to consumers.

We ask that you attempt to communicate all concerns with your therapist directly and/our, quality assurance or supervisory team as a first step if it feels safe to do so. Our supervisory team will ensure that your complaints are addressed with all associate level therapists in a timely manner! Our quality assurance team will ensure that complaints are addressed with our licensed staff in a timely manner. We want to ensure that you feel safe in the counseling setting. If you feel your needs are not met by a member of the rose city team the information for reporting with the counseling board can be found below. Your safety is our top priority!

In Texas, Licensed Professional Counselors (LPCs) must provide a consumer's health records within 15 business days of a written request, allowing for reasonable copying/mailing fees but not retrieval fees, and cannot withhold records for unpaid bills; records should only be released if the client (or guardian) signs a release specifying the info, with exceptions for potential harm to the client, requiring a written statement detailing the denial, as governed by the
Texas Behavioral Health Executive Council (BHEC) and state law.

Written Request: The consumer must provide a written request, signed by them (or their legal representative).

Specific Information: The request must identify the specific records to be disclosed and who can receive them.

15-Day Deadline: Records must be provided within 15 business days of receiving the request.

Reasonable Fees: You can charge for actual costs of copying and mailing, but not retrieval or review.

No Withholding for Debt: You cannot deny access due to unpaid fees for services.

Potential Harm Exception: You can deny access to portions of a record if releasing it would likely harm the patient's physical, mental, or emotional health, but must provide a signed, dated written statement explaining the denial and its duration.

Release Only Requested Info: You should only release the specific information requested, not the entire file, unless the request covers everything.
